Why Women Need Economic Power, Not Just Failed Promises of Legal Rights

The United Nations’ theme for International Women's Day 2026 is "Rights. Justice. Action. For ALL Women and Girls." According to UN Women's latest data, women globally hold just 64% of the legal rights of men. At the current pace of legislative reform, it will take 286 years to close those legal protection gaps.

Two centuries and eight decades is not a timeline for justice; it is an admission of systemic failure. While the UN correctly identifies the crisis, rising impunity, the rollback of rights, deeply rooted discrimination, relying on the slow gears of bureaucratic reform is fundamentally inadequate. Women do not have centuries to wait.

The Mutualist Party recognizes the severe limitations of this approach. While we don't dismiss legal reform outright, waiting for perfect laws is a luxury women cannot afford while economic violence accelerates daily. Economic self-organization offers a direct, immediate route to justice. We have to build parallel systems of power that do not ask for permission to exist.


The Legal Reform Trap

The UN Secretary-General's report highlights a bleak reality: in 54% of countries, rape is still not defined by consent. Girls can be legally forced to marry in nearly three out of four nations. In 44% of countries, equal pay for work of equal value isn't mandated by law. Digital violence is surging, and impunity remains the global standard.

UN Women Executive Director Sima Bahous notes that denying justice erodes public trust and weakens the rule of law. What the UN framework misses, however, is that a legal system requiring 286 years to grant basic equality has already lost its legitimacy entirely.

Legal reform is bottlenecked by state machinery captured by elite interests and bogged down by political backlash. Every hard-won protection is fragile and endlessly negotiated. All the while, the economic violence inflicted on women, wage theft, the extraction of unpaid care labor, data exploitation, displacement via automation, continues unabated.

Take the UN's "Ring the Bell for Gender Equality" campaign, which asks capital markets to be more inclusive. It effectively demands that women petition for entry into systems explicitly built on their extraction, assuming justice will eventually trickle down. But justice does not trickle down. It flows from power, and power is rooted in ownership.

We need parallel systems of economic power operating independently of state permission, institutions that convert extraction into ownership and participation into governance. We need Modern Mutualism.


Capitalism vs. Modern Mutualism: Two Paths Forward

The choice is between an economic framework that extracts from women and offers protection later, and one that builds ownership right now.

Capitalism: You Rent Your Existence. Modern Mutualism: You Own Your Extraction.

Under capitalism, women's lives and labor are treated as resources to be mined. Platforms monetize their attention, landlords profit from basic housing needs, and automation displaces labor to enrich distant shareholders. The standard response is to beg for regulation, hoping the state has the will and capacity to enforce laws limiting this extraction.

Modern Mutualism builds community wealth trusts to reverse this dynamic. Instead of being extracted from, you own a stake in the systems that utilize your data, your neighborhood's land, and your region's automation. This goes beyond a universal basic income, which functions as state charity. This is true ownership, and ownership distributes power directly. If women own the platforms monetizing their attention, they don't have to wait lifetimes for equal pay legislation; they vote on compensation directly. If they collectively own the land beneath their homes, they don't have to lobby for rent control.

Capitalism: Pay for Time. Modern Mutualism: Pay for Provenance.

The current system values labor strictly based on time logged in formal employment, systematically marginalizing women who perform the bulk of care work, emotional labor, and invisible social maintenance. The usual fix is trying to force women into existing labor markets that fundamentally devalue this work because it doesn’t generate corporate profit.

Modern Mutualism shifts the paradigm: economic value is tied to the provenance of creation and community sustenance. Whether you are working in a factory or generating data on a platform, your contribution is tracked and compensated through universal dividends. This automatically values the essential labor women have always performed, distributing resources without waiting for a government to officially recognize its worth.

Capitalism: Workers Are Costs. Modern Mutualism: Workers Are Owners.

When automation displaces women or platforms cut pay rates to optimize profits, traditional frameworks offer minimal severance or push for anti-discrimination regulations that are nearly impossible to enforce against black-box algorithms.

Modern Mutualism relies on platform cooperatives that provide structural protection. If your specific job is automated, you retain shares in the enterprise. If rent goes up, you have a vote on the board setting the prices. You are an owner, not a disposable cost center. When the means of extraction are collectively owned, the profits from women's labor and creativity flow back to them.

Capitalism: Absentee Control. Modern Mutualism: Community Stewardship.

Capitalism divorces ownership from use. Landlords hoard housing, platforms hoard user data, and investors control automation they don't operate. The standard defense involves tenant protection laws and privacy regulations, all easily weakened by corporate lobbying.

Modern Mutualism establishes community stewardship. Homes are secured through use rather than absentee title, and digital identities are protected through collective data trusts. A community land trust doesn't need a new law passed to provide affordable housing, and a data cooperative doesn't need regulatory approval to shield its members' privacy.

Capitalism: Fines for Violations. Modern Mutualism: Power for Violations.

Today, corporate extraction is managed through fines. Privacy breaches and wage theft result in financial penalties that tech giants treat as the cost of doing business.

Modern Mutualism implements structural penalties where violations directly translate into transferred power. A privacy breach doesn't just trigger a fine; it forces a transfer of ownership shares to the victims. Uncompensated automation converts into governance rights for displaced workers. This is justice defined by structural power rather than symbolic punishment.


Action, Not Just Rights: Building the Parallel Economy

The UN's call for action is correct, but the execution falls short. While international commissions debate inclusive legal systems, women face immediate economic violence. We propose a dual-power strategy. We do not abandon legal reform, but we refuse to be held hostage by its pace.

Support legal reform where it makes sense. Vote for representatives who back equal rights and support precedent-setting litigation. But do not wait for the system to save you.

Build mutualist institutions right now. Launch credit unions that invest in women-owned cooperatives. Convert your platform usage into cooperative platform ownership. Organize community land trusts to pull housing off the speculative market. Form data cooperatives to bargain collectively with tech giants.

Treat every extraction as a claim to ownership. A privacy violation is evidence for equity. An automated job is leverage for a buyout. A rent hike is the catalyst for cooperative conversion. Document the extraction, organize the response, and build the alternative.

The 286-year timeline assumes we will keep asking for scraps from a table we didn't build. 

Modern Mutualism says: build your own table, set your own terms, and force the law to catch up to economic reality.


An Intersectional Mutualism

Unlike legal reform, which relies on the capacity and political will of wealthy states, economic self-organization scales horizontally and reaches the most marginalized immediately.

Migrant women can join platform cooperatives without citizenship papers. Women in conflict zones can utilize mutual credit outside of collapsed banking sectors. Survivors of domestic violence can access and control economic resources independent of patriarchal court systems. Women in the Global South can secure data sovereignty without waiting to copy Western legislative models.

When justice is hardcoded into economic architecture, it becomes borderless and irrevocable. Trans women facing employment discrimination can secure income through cooperatives that don't require background checks or legal name changes. Disabled women excluded from traditional jobs can earn through data dividends. Indigenous women can assert stewardship over their territories through trusts based on use rather than colonial property titles.

The UN assumes a linear progression: first rights, then justice, then action. Modern Mutualism flips this. Action establishes economic facts. Economic facts build power. Power forces justice. And justice, ultimately, creates rights, not as gifts granted from above, but as the formal recognition of reality on the ground.


Justice Is Built, Not Granted

The UN is right that justice must be actively built and funded. But justice is built through ownership, not just advocacy.

While international bodies convene to debate discriminatory laws for the seventieth time, mutualist women are already building credit unions, seizing platforms, and securing their economic destinies. They are not waiting three centuries for permission, and they are not waiting for next year's theme.

They are organizing today.

The future of women's rights will not be decided in legislative chambers. It is being built in the cooperatives we form, the trusts we establish, and the ownership we claim right now.

Justice delayed is justice denied. Immediate ownership is justice achieved.
